Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Webrich Software (“we”, “us”) for your use of the SafePath OSHA iOS app and the SafePath OSHA website (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices that you own or control, solely for your personal, non-commercial study and field-support use. You may not copy, modify, reverse-engineer, distribute, sublicense, or create derivative works of the app or its content, except as expressly permitted by applicable law. All intellectual property in the app, its content (questions, explanations, reference cards, images, copy), and the SafePath OSHA marks remains with Webrich Software.

2. Educational Use; No Affiliation with OSHA

SafePath OSHA is an independent study and field-support app. It is not affiliated with, endorsed by, or connected to the U.S. Department of Labor, OSHA, or any OSHA-authorized Outreach training provider. Completion of in-app practice or mock exams does not satisfy the OSHA 10-hour or OSHA 30-hour Construction Outreach training requirement, and does not produce an OSHA Outreach Trainer card. Only an OSHA-authorized Outreach trainer can issue an OSHA Outreach card.

3. SafePath Pro Auto-Renewable Subscription

Some features of the app are available only with an active “SafePath Pro” subscription. The following terms apply to all SafePath Pro purchases:

  • Title of subscription: SafePath Pro (subscription group com.safepath.osha.pro).
  • Lengths offered: 1 month, 3 months, 6 months, and 1 year. The exact lengths offered, and the price for each length, are shown inside the app on the Pro screen at the time of purchase.
  • Price: Prices are shown inside the app in your local currency, sourced live from the App Store. A per-month equivalent price is also shown when a multi-month length is selected.
  • Free trial: A subscription may include an introductory free trial. If shown, the trial length is displayed inside the app next to the subscription length before you confirm purchase. Any unused portion of a free trial is forfeited when a paid subscription is purchased.
  • Auto-renewal: Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews for the same length at the then-current price, unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal billing: Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the cost of the chosen subscription length.
  • Managing & canceling: You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings: apps.apple.com/account/subscriptions. Canceling stops future renewals; the current paid period continues until its scheduled end date.

4. Free Tier

The free tier of the app includes four starter topics per OSHA program with up to 25 questions per starter topic, one mock exam per program, a 3-worker crew roster, and a 1-credential wallet. Free features may change over time as the app is improved.

5. Refunds

All subscription purchases are processed by Apple. Refund requests are handled by Apple under its policies. You can request a refund at reportaproblem.apple.com. Webrich Software cannot issue refunds for App Store purchases.

6. Content Accuracy & Field Use

We work to keep practice questions, explanations, reference material, and calculators accurate and aligned with OSHA construction standards. The Service is provided for educational and field-support reference. It is not a substitute for OSHA-authorized training, a competent person’s judgment on a jobsite, a safety professional’s review, or legal advice. Always defer to your employer’s safety program, an OSHA-authorized trainer, and the actual text of the applicable OSHA standard on a live jobsite.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by law, Webrich Software is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total cumulative liability for any claim arising out of or relating to the Service is limited to the amount you paid to us through the App Store for the Service in the twelve months before the event giving rise to the claim.

9. Termination

We may suspend or terminate access to the Service at any time, with or without cause, including for breach of these Terms. Upon termination, the license granted in Section 1 ends, and you must stop using and delete the app.

10. Apple End User License Agreement

You and Webrich Software acknowledge that these Terms are between you and Webrich Software, not Apple, and that Webrich Software (not Apple) is solely responsible for the app and its content. To the extent these Terms are less restrictive than, or otherwise conflict with, Apple’s standard end-user license agreement for applications licensed through the App Store, Apple’s standard EULA controls. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the latest version. Continued use of the Service after a change indicates acceptance of the revised Terms.
